These Terms of Service (“Terms”) describe our commitments to you, and your rights and responsibilities when using FretPulse. Please read them carefully. If you don’t agree to these Terms, do not use our services.

These Terms govern your access to and use of the FretPulse application, website, and related services (collectively, our “Services”) provided by FretPulse LLC (“we”, “us”, or “our”).

1. Your account and use of the Services

When you create an account to use FretPulse, you agree to provide us with complete and accurate information. You are solely responsible and liable for all activity under your account. You are fully responsible for maintaining the security of your account credentials. Do not share or misuse your access credentials, and notify us immediately of any unauthorized uses of your account.

Our Services are not directed to children. You are not allowed to access or use our Services if you are under the age of 13 (or 16 in Europe). By using our Services, you represent that you meet these age requirements and can legally form a binding contract.

2. Fees, payment, and renewal

  • Paid services: FretPulse operates on a subscription model (Monthly or Annual). By using a Paid Service, you agree to pay the specified fees.
  • Payment: You must provide accurate and up-to-date payment information. Payments are processed securely via our third-party payment provider (Stripe).
  • Automatic renewal: By enrolling in a subscription, you authorize us to automatically charge the applicable fees and taxes for each subsequent subscription period until canceled. You can cancel your subscription at any time through your account settings.
  • Refunds: Unless strictly required by law, there are no refunds and all payments are final. If you cancel, you will retain access to FretPulse until the end of your current billing cycle.

3. Prohibited uses

You represent and warrant that your use of our Services will strictly comply with these Terms and all applicable laws. You will not:

  • Use the Services for any unlawful purposes.
  • Interfere with, disrupt, or attack our systems or networks.
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code for the Services.
  • Rent, lease, sell, or resell the Services or related data.

4. Intellectual property

These Terms do not transfer any FretPulse LLC or third-party intellectual property to you. All right, title, and interest in and to such property remains solely with FretPulse LLC. FretPulse, the FretPulse logo, and all other trademarks, graphics, and logos used in connection with our Services are trademarks or registered trademarks of FretPulse LLC.

5. Termination

We may terminate your access to all or any part of our Services at any time, with or without cause, effective immediately, if we believe you have violated these Terms. You can stop using our Services at any time by canceling your subscription and deleting your account.

6. Disclaimers and limitation of liability

Our Services are provided “as is.” FretPulse LLC hereby disclaims all warranties of any kind, express or implied. We do not guarantee that our Services will be error-free or that access will be continuous or uninterrupted.

In no event will FretPulse LLC be liable under any contract, negligence, strict liability, or other legal theory for: (i) any special, incidental, or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to FretPulse LLC under this agreement during the twelve (12) month period prior to the cause of action.

7. Indemnification

You agree to indemnify and hold harmless FretPulse LLC, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all losses, liabilities, demands, damages, costs, claims, and expenses, including attorneys’ fees, arising out of or related to your use of our Services.
